Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website at imagiluxion.ai and the related services (the "Service") provided by imagiluxion ("imagiluxion", "we", "us", or "our"), operated by an individual based in Singapore. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of the Service

imagiluxion is an AI API platform that provides a unified interface for accessing third-party artificial-intelligence models (including text, image, and video generation) supplied by upstream providers. We route requests you submit to the provider you select and meter your usage against prepaid credits or quota.

2. Eligibility and Accounts

• You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract.
• You are responsible for the accuracy of your account information and for all activity that occurs under your account.
• You must keep your password and API keys confidential. You are responsible for any use of your API keys, whether or not authorized. Notify us immediately of any suspected unauthorized use.

3. Acceptable Use Policy

You agree not to use the Service to generate, request, upload, or distribute any of the following, all of which are expressly prohibited:

• Sexually explicit, pornographic, adult, or "NSFW" content of any kind, including AI-generated sexual, nude, or suggestive imagery or text;
• Child sexual abuse material (CSAM) or any content that sexualizes, endangers, or exploits minors;
• Face-swap, deepfake, or face-manipulation content, non-consensual intimate imagery, or content that impersonates a real person without their consent;
• content that is illegal, infringing, defamatory, harassing, hateful, or that promotes violence, self-harm, terrorism, or other illegal activity;
• attempts to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service or its infrastructure;
• reselling, redistributing, or sublicensing access in a manner that violates the terms or usage policies of the relevant upstream AI providers;
• circumvention of usage limits, billing, security controls, or content-moderation systems.

Content moderation. All prompts submitted to our image and video generation endpoints are automatically screened by an automated content-moderation system before generation occurs. Requests that are flagged as violating this Acceptable Use Policy are blocked, and we may suspend or terminate accounts that violate it.

Your use of upstream models is additionally subject to the acceptable-use and content policies of the respective upstream providers. You are responsible for complying with those policies.

4. Fees, Credits, and Billing

• The Service operates on a prepaid basis: you purchase credits or quota that are consumed as you use the Service. Pricing for each model is displayed within the Service and may change at any time.
• Payments are processed by our third-party payment provider, Creem. By making a purchase you also agree to Creem's terms. We do not store full payment-card details.
• Credits are consumed based on your actual usage (for example, tokens, requests, generated media, resolution, or duration, depending on the model). You are responsible for all charges incurred under your account.
• Unless required by law or stated in our Refund Policy, purchases are final once credits are consumed.

5. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

6. Third-Party Services and Availability

The Service depends on third-party upstream providers and infrastructure. We do not control, and are not responsible for, the availability, accuracy, or output of upstream models. The Service is provided on a reasonable-efforts basis and may be subject to interruptions, maintenance, rate limits, or changes imposed by upstream providers. We may modify, suspend, or discontinue any part of the Service at any time.

7. AI-Generated Output

Outputs are generated by third-party models and may be inaccurate, incomplete, or unsuitable for your purpose. You are solely responsible for evaluating and using outputs, and for ensuring your use complies with applicable law and any rights of third parties. We make no representation that outputs are original or non-infringing.

8. Intellectual Property

The Service, including its software, design, and trademarks (including "imagiluxion"), is owned by us or our licensors and is protected by applicable laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. Rights in inputs and outputs are governed by these Terms and the applicable upstream provider terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMAGILUXION WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless imagiluxion from any claims, damages, liabilities, and expenses arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

12. Suspension and Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms, if required by law, or to protect the Service or other users. You may stop using the Service and request account deletion at any time. Provisions that by their nature should survive termination will survive.

13. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of Singapore, without regard to its conflict-of-laws rules. The courts of Singapore will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, subject to any mandatory consumer-protection rights you may have in your place of residence.
